1. Who we are
These Terms & Conditions ("Terms") form a binding agreement between you and Rasmere("Rasmere", "we", "us", "our"), the provider of the Rasmere planning risk intelligence service accessible at rasmere.com (the "Service"). By creating an account, purchasing a report, or otherwise using the Service, you agree to these Terms.
2. Acceptance
By continuing to access or use the Service you confirm that you accept these Terms and that you have the authority to do so on behalf of yourself or any organisation you represent. If you do not agree, you must stop using the Service.
3. The Service
Rasmere provides pre-submission planning risk reports based on historical published planning decisions from UK local planning authorities. Reports are produced for general information and risk-assessment purposes only and do not constitute planning, legal, surveying, or professional advice. Decisions about whether to submit a planning application remain your responsibility.
4. Accounts and credentials
You must provide accurate registration information and keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
5. Acceptable use
You must not:
- use the Service for any unlawful, fraudulent, or deceptive purpose;
- send spam or unsolicited communications via the Service;
- infringe any intellectual property or other rights of any third party;
- introduce malware, attempt to probe, scan, or test the vulnerability of the Service, or otherwise interfere with its security or integrity;
- scrape, harvest, or republish data from the Service except as expressly permitted; or
- reverse engineer, resell, or redistribute the Service or its outputs without our prior written consent.
6. Intellectual property
Rasmere and its licensors retain all right, title, and interest in and to the Service, including all software, models, documentation, branding, and report templates. We grant you a limited, non-exclusive, non-transferable right to access and use the Service and the reports we provide to you, solely for your own internal business or personal property-development purposes.
7. Service availability
We work hard to keep the Service available, but we do not guarantee that it will be uninterrupted, timely, secure, or error-free. We may modify, suspend, or discontinue all or part of the Service at any time, with or without notice.
8. Payments, subscriptions, and Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, cancellations, and refund mechanics are governed by the Paddle Checkout Buyer Terms.
Subscription plans renew automatically at the end of each billing period unless cancelled. You can cancel at any time from your dashboard, in which case access to paid features ends immediately. One-off report purchases grant a single report credit per purchase and are non-recurring.
9. Refunds
Refunds are handled in accordance with our Refund Policy and Paddle's policies. To request a refund, visit paddle.net or contact team@rasmere.com.
10. Warranties and disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. Reports are based on historical, publicly available data and may not reflect current planning policy or future decisions.
11. Limitation of liability
To the fullest extent permitted by law, Rasmere's aggregate liability arising out of or in connection with the Service in any 12-month period shall not exceed the fees paid by you to us (via Paddle) in the 12 months preceding the event giving rise to the liability. We exclude liability for any indirect, consequential, or special damages, including loss of profits, revenue, data, or goodwill. Nothing in these Terms limits our liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be excluded under applicable law.
12. Indemnity
You agree to indemnify and hold Rasmere harmless from any claims, losses, or damages arising from your misuse of the Service, your breach of these Terms, or content you submit to the Service.
13. Suspension and termination
We may suspend or terminate your access to the Service at any time, with or without notice, if: (a) you materially breach these Terms; (b) we have reason to believe your account is being used fraudulently or poses a security risk; (c) payment for your plan fails or is reversed; or (d) we are required to do so by law. On termination, your right to use the Service ends immediately. Sections of these Terms that by their nature should survive termination will do so.
14. Governing law and disputes
These Terms are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Service.
15. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated via the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
